1. Acceptance of Terms

By downloading, installing, or using Herbal Vanguard ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you ("User", "you") and Herbal Vanguard ("we", "us", "our"). We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

2. Description of Service

Herbal Vanguard is a wellness tracking and educational application that provides:

• A database of 118+ herbs, supplements, and probiotics with general information
• Daily tracking tools for supplements, meals, water intake, and exercise
• AI-powered wellness insights and educational content
• Rife frequency playback and ambient sound features
• Progress journaling and photo documentation
• Data export capabilities

3. Educational Disclaimer

By using this App, you acknowledge and agree that:

• The App is not a substitute for professional medical advice, diagnosis, or treatment
• You should always consult a qualified healthcare provider before starting, stopping, or modifying any supplement regimen
• Herb and supplement information is provided for educational purposes and may not account for your individual health conditions, medications, or circumstances
• AI-generated content is educational in nature and should not be relied upon as medical guidance
• Rife frequencies are provided as a wellness tool and are not FDA-approved treatments for any condition
• You assume full responsibility for any decisions you make regarding your health based on information from this App

4. User Responsibilities

As a user of Herbal Vanguard, you agree to:

• Use the App only for lawful, personal, non-commercial purposes
• Not rely on the App as your sole source of health or wellness information
• Consult a healthcare professional before acting on any information provided by the App
• Be at least 13 years of age (or the age of digital consent in your jurisdiction)
• Maintain the security of your device, as your data is stored locally
• Not attempt to reverse-engineer, decompile, or extract source code from the App

5. AI-Powered Features

The App includes AI-powered features that generate responses based on your queries. Regarding these features:

• AI responses are generated algorithmically and may contain inaccuracies
• AI features are rate-limited for quality and fairness (50 queries per day, 15-second cooldown)
• We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content
• AI features require an internet connection and may be temporarily unavailable
• You should independently verify any AI-generated information before acting on it

6. Subscriptions & Payments

6.1 Free Tier

The App offers a free tier with core features including the herb database, daily diary, progress journal, and limited AI usage.

6.2 Premium Subscriptions

Premium features are available through in-app subscriptions processed by Apple App Store or Google Play Store. By subscribing:

• Payment is charged to your App Store or Play Store account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your device's account settings
• No refunds will be issued for partial subscription periods

6.3 Free Trials

If a free trial is offered, it will automatically convert to a paid subscription unless canceled before the trial ends. Any unused portion of a free trial is forfeited upon subscribing.

7. Intellectual Property

All content, design, code, graphics, logos, and other materials in the App are owned by Herbal Vanguard or its licensors and are protected by intellectual property laws. You may not:

• Copy, modify, or distribute App content without written permission
• Use the Herbal Vanguard name, logo, or branding for any unauthorized purpose
• Claim ownership of any AI-generated protocols or content produced by the App

Content you create within the App (journal entries, photos, custom notes) remains your property.

8. Prohibited Uses

You agree not to use the App to:

• Provide medical advice or represent yourself as a healthcare professional through App features
• Distribute harmful, misleading, or dangerous health information
• Attempt to access other users' data or compromise App infrastructure
• Use the App for any illegal purpose
• Automate or script interactions with AI features
• Resell, sublicense, or commercially exploit the App or its content

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The information, content, or AI-generated responses will be accurate, reliable, or complete
• Any defects in the App will be corrected
• The App will be compatible with all devices or operating systems

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HERBAL VANGUARD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, HEALTH COMPLICATIONS, OR DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Herbal Vanguard from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

You may terminate your use of the App at any time by uninstalling it from your device. You may delete all locally stored data through the "Delete All Data" option in Profile settings before uninstalling.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through:

• An in-app notification or banner
• An updated "Last Updated" date on this page

Your continued use of the App after modifications constitutes acceptance of the revised Terms.
